INTRODUCTION
This Privacy Policy for the Processing and Protection of Personal Data within the scope of the Web Portal and Forms of NAKAGAWA CONSULTORES REGULATORIOS S.A.C. (hereinafter, “THE CONSULTANT”) has as its purpose, to regulate the conditions for the processing of personal data collected by THE CONSULTANT through the Web Portal and Forms.
THE CONSULTANT declares that this Policy is framed with the criteria and parameters established in the Personal Data Protection Norms.
THE CONSULTANT respects and values the privacy of the users of this website. Therefore, the purpose of this Privacy Policy is to inform what kind of information is collected and how it is used, stored and disclosed, so that users can freely decide whether or not to share their information.
It is expressly stated that visiting the web portal does not imply the obligation, directly or indirectly, to provide “personal data”. However, if the user or users submit requests -through the forms contained in the web www.nakagawa.pe–, or access our services, or participate in the events that THE CONSULTANT promotes, among others, it may require the delivery of specific and necessary personal data for that purpose.
CONSENT
According to the Forms contained in the website www.nakagawa.pe, and the information that can be stored in them, the following Privacy Policy applies. The filling of the Forms and the acceptance of the legal notice, represent the express consent of the Data Subject to the collection of his/her Personal Data and to its Processing for the specific purposes for which it was collected.
THE CONSULTANT may revise, modify, add or delete the provisions of this Privacy Policy at any time. In the event that this is done, this will be notified on the same website. By continuing to use the website after receiving notice of the updated Privacy Policy, you acknowledge and agree that you have read and understand the revised Privacy Policy.
Any comments or concerns regarding the Privacy Policy or the enforcement of any of these shall be notified in writing to THE CONSULTANT at the following address: administración@nakagawa.pe.
THE CONSULTANT collects information from users when they submit it directly by filling out forms on the website. Information is also collected from users when they browse the website, as detailed below. Some of the methods THE CONSULTANT uses to collect data are automatic and will take effect automatically as users browse the website.
USER REGISTRATION AND PROTECTION OF PERSONAL DATA
It will be a necessary and indispensable requirement, the acceptance of these conditions by the user. The terms and conditions of this Privacy Policy shall be understood to be known and accepted by the fact of express acceptance by means of the user’s expression of will by clicking on the respective box.
The registration of each user will be verified by completing and subscribing the forms that are published in www.nakagawa.pe; and through their subsequent submission, which is done automatically by “clicking” on the respective element. The forms will require the following information from the user: full name, identity card number, telephone number, e-mail address. It should be noted that these data are not restrictive of others that may be requested.
It is expressly stated that the Personal Data provided through the Forms must be, under your responsibility, true, complete, accurate, current and correspond to your true identity. Therefore, in the event of any kind of damage or harm, direct or indirect, that may arise for THE CONSULTANT or for third parties as a consequence of the partial or total breach of the obligation referred to in this paragraph, it shall be the sole and exclusive responsibility of the natural person who provided the information.
The user who chooses to sign the form will be freely, previously, unequivocally and expressly authorizing the processing of his/her personal data in the personal data bank of THE CONSULTANT, being used for evaluation for purposes of pre-professional practices, legal and/or economic assistance and/or support in academic research, and/or related and/or similar, by THE CONSULTANT, under the applicable legal regulations.
It is expressly stated that the submission of personal data and prior coordination between users and THE CONSULTANT does not imply that a contract or labor agreement or binding commitment of any nature is being entered into. Likewise, the user accepts that the personal data provided may be transferred to affiliated companies and/or companies related to the same economic group, whether these companies are incorporated in Peru or abroad.
THE CONSULTANT is the owner of the personal data bank in which all personal data provided in the forms available on the site www.nakagawa.pe will be compiled, and will not transfer, under any modality and to any company to which the user has not given consent, personal data of such users registered on this site. The information received is stored in our servers and will be handled in an absolutely confidential manner and in accordance with the current legislation in force in Peru.
The user may exercise the rights of revocation recognized in Law 29733 – Personal Data Protection Law, against THE CONSULTANT. For this purpose, in the website www.nakagawa.pe there is a link so that they can update their preferences and/or unsubscribe in order to no longer receive any further communications from THE CONSULTANT.
If the user does not wish to receive advertising, promotions, invitations to activities and surveys, according to the preceding paragraph, they can update their preferences and/or unsubscribe in order to no longer receive communications from THE CONSULTANT. It should be noted that the data provided for registration on the web is not sensitive data.
PERSONAL INFORMATION: USE AND STORAGE OF INFORMATION
In general, THE CONSULTANT may use the information provided to improve the site, its services, and for the specific purpose for which the user has provided the information.
THE CONSULTANT will not use users’ personal information to offer, market or advertise products and services of third parties unless THE CONSULTANT first obtains the consent of such third parties to do so.
THE CONSULTANT may use user communications in the same manner that it uses personal information. In that regard, THE CONSULTANT may maintain records of user communications indefinitely.
THE CONSULTANT may use non-personal information to maintain, evaluate and improve its web site and the products it provides. THE CONSULTANT may retain non-personal information indefinitely.
DISCLOSURE OF THE COLLECTED INFORMATION
THE CONSULTANT does not share users’ personal information with third parties other than as set forth in this Privacy Policy.
THE CONSULTANT cannot be responsible for protecting user information if users choose to share such information on publicly available portions of the site.
If THE CONSULTANT undertakes corporate transformations of merger, acquisition, spin-off or through branches, it may share users’ information with that new company. This situation will be notified to users in accordance with the notification provisions of the Terms of Use.
THE CONSULTANT may share user information with third parties as permitted or required by applicable law, court order, or other judicial or administrative request from government entities. It may also disclose such information if THE CONSULTANT determines that such disclosure is necessary to protect THE CONSULTANT’s rights, or is necessary for national security, law enforcement or other matters of public importance. Such disclosures may occur in the context of an investigation or to prevent or take action against illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person and violations of THE CONSULTANT’s terms of service.
THE CONSULTANT may disclose user information to third parties who assist in maintaining, evaluating, improving and providing the website, services and any other products and services of THE CONSULTANT.
SECURITY OF PERSONAL INFORMATION ABOUT USERS
THE CONSULTANT applies reasonable measures to protect the information it collects about users. However, we must recognize that no security measures are foolproof, and THE CONSULTANT cannot guarantee the absolute security of such information despite considering reasonable measures to protect it. In the event that THE CONSULTANT becomes aware of a breach of security, unauthorized disclosure or inadvertent disclosure of your information, users agree that THE CONSULTANT may notify them of such an event using the notification provisions of the Terms of Use.
Users are also responsible for maintaining the security of their account.
USER RIGHTS
Users have the right to request that THE CONSULTANT does not process their personal data for marketing purposes. THE CONSULTANT will inform users (prior to collecting their data) if it intends to use their data for such purposes or if it intends to disclose their information to a third party for such purposes.
THE CONSULTANT’s website may contain links to and from the websites of our partner networks, advertisers and affiliates, among others. If users follow a link to any of these websites, they should note that these websites have their own privacy policies and that THE CONSULTANT accepts no responsibility or liability for these policies.
The Data Protection Law grants users the right to access, rectify and cancel the information that THE CONSULTANT holds about them, as well as the right to oppose and restrict the processing of such personal information. These rights may be exercised in accordance with the Personal Data Protection Law and its regulations.
The site www.nakagawa.pe uses cookies to manage sessions, navigation, access and user entries and store preferences, as well as to track information, among others. Cookies can be used independently of user registration, so by accessing our site you agree to their use for commercial purposes. The registration e-mail is used to track the requests made as well as to receive promotions. Only customers who authorize this service through registration will receive promotional messages from www.nakagawa.pe.
If you wish to stop receiving our promotions and/or newsletters by e-mail, click on “I do not wish to receive e-mail messages” at the end of the e-mail, or send an e-mail to administración@nakagawa.pe and you will be excluded from our database and newsletters, if applicable.
In turn, the exercise of these rights is free of charge. To do so, the user must send an e-mail to administración@nakagawa.pe specifying the right or rights he/she wishes to exercise and attaching a copy of a valid identity document proving his/her ownership of the Personal Data.
The request will be processed in accordance with the deadlines set forth in the Personal Data Protection Regulations.
